WORKSHOP DESCRIPTION: Interactive workshop on preparation of "bullet-proof" awards. Emphasis on outlining, drafting, editing and writing awards in all binding arbitrations. Hypothetical case summary used as basis for drafting. Participation by attendees welcomed and expected.

WORKSHOP GOALS, OBJECTIVES, AND REQUIREMENTS: 

  • Goals: To provide attendees with the opportunity to evaluate the alternatives to, and strengths and weaknesses of, their approach to preparing arbitration awards.
  • Objectives: (1) Understanding the mandatory features of arbitration awards; (2) familiarity with ethics and ethical conduct in preparing awards; (3) self-critiquing of arbitration award drafts; (4) comprehending the relevant statutory and rule-based framework and significant case law governing awards; (5) learning how to draft an arbitration award that will meet the needs of the parties and the arbitrator; (6) evaluatiing award revisions; (7) understanding the roles, responsibilities and authority of the arbitrator as they pertain to award-writing; (8) developing an appreciation of the importance of careful preparation of one’s award; (9) developing one's own outline/checklist for award preparation; and (10) experiencing the presentation/editing of awards based on "hypothetical" case on which "awards" will be drafted.
  • Requirements: Outline legible draft award from hypothetical case which will be faxed/E-mailed to attendees no less than one week before workshop begins.
