Special Referee

1. What does a special referee do?

He/she takes evidence and makes factual findings regarding a part of a dispute. These are then binding on the parties as they resolve their larger difference through arbitration or litigation.

2. Why would someone want to use a special referee?

Special referees are frequently used to handle a discrete portion of a dispute that may involve an accounting, technical inquiries, defect/repair claims, or deciding numerous individual claims. They are also frequently used to handle discovery disputes.
